Definitely technical beyond my skill set, but from how I understand the mechanics the exchange would be in-place prior to the foreclosure. I actually have met with some experts who are currently working in this area and would be more than happy to make an introduction. The hapless investor would bring a 1099-C to the table - what would the offset be? Or would this occur prior to foreclosure? Maybe the banks, who have operating losses due to the HERA legislation, could come into play...

- Interested if anyone is seeing distressed investors utilizing 1031 exchanges for capital gain relief on foreclosures? Just met with a company who works in this area utilizing NNN zero cash flow deals. Pretty technical for me but thought I'd ask the question!
